By accessing or using bms.web (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you are strictly prohibited from using the Service.

bms.web is the portfolio and social networking platform operated by Braj Mohan Singh. The Service allows users to create profiles, publish blogs, showcase projects, and engage in social networking (following, liking, commenting).

3. User Conduct and Restrictions

You agree NOT to engage in any of the following prohibited activities:

• Violating any applicable local, state, national, or international law.
• Posting defamatory, abusive, harassing, or hate speech content.
• Attempting to bypass security mechanisms, rate limits, or access controls.
• Deploying automated bots to scrape data, artificially inflate engagement, or spam endpoints.
• Uploading malicious code, scripts, or viruses.

Violation of these terms grants us the right to instantly terminate your account without notice.

4. Intellectual Property and DMCA Notice

You retain ownership of any content you upload. However, by uploading content, you grant bms.web a worldwide, non-exclusive, royalty-free license to host, display, and distribute it on the platform.

DMCA Takedown Procedure

If you believe your copyrighted work has been infringed upon by a user of this platform, please submit a formal DMCA takedown notice via our Contact Form, including:

• A physical or electronic signature of the copyright owner.
• Identification of the copyrighted work claimed to be infringed.
• Identification of the material to be removed (with URLs).
• Your contact information (email and phone).
• A statement of good faith belief that the use is not authorized.

5. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Braj Mohan Singh and bms.web from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms of Service; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your user-generated content caused damage to a third party.

We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 7. LIMITATION OF LIABILITY

In no event shall Braj Mohan Singh be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Binding Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in India. You agree to waive any right to participate in a class-action lawsuit or class-wide arbitration. Individual claims only.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
